TERMS AND CONDITIONS SANTONI SOCIETY
- Scope of Application
These terms and conditions govern the membership programme run by Santoni S.p.A. (hereinafter also “Santoni”) and entitled “Santoni Society”. To participate in the programme, you are required to agree and accept these terms and conditions at the time of joining the programme.
Santoni Society is an exclusive programme that offers members the opportunity to become part of a select community, with access to special benefits, personalized services and unique experiences, organized by Santoni at its discretion and publicised through the communication channels that Santoni deems fit.
The Santoni Society programme is valid exclusively for initiatives organized by Santoni S.p.A. Accordingly, any loyalty and/or promotional initiatives proposed by Santoni retailers to customers in association with the purchase of Santoni products shall remain the liability of those retailers.
Santoni may modify, supplement and/or amend these terms and conditions at any time. As such,you are advised to always check back for any changes or updates. - Santoni Society Card
Inside the boxes of Santoni products, you will find a card (hereinafter “Santoni Society Card” or simply the “Card”) bearing a unique code certifying its uniqueness, which you are required to keep in a safe place. Santoni shall not be liable in the event of theft, loss or improper use of the Card by third parties.
Customers agree to use the Santoni Society Card in accordance with the provisions of these terms and conditions. - Suspension and/or Deactivation of the Santoni Society Programme
Santoni reserves the right to suspend and/or deactivate the Santoni Society programme at any time and, by doing so, cancel any benefits already earned by the Customer. Santoni may suspend and/or deactivate the programme as it deems fit, with notification thereof sent to the Customer in advance. In the event of suspension and/or cancellation, you shall not be entitled to claim indemnification and/or compensation of any kind, in particular in the following cases:
• in the event of theft or other fraud committed or attempted by the cardholding Customer at a Santoni sales outlet or on the Santoni e-commerce website;
• in the event of improper use of the Card;
• more generally, in the event of abuse or breach by the Customer of any or all of these terms and conditions or of the provisions of law. - Privacy and Cookie Policy
Full information on how Santoni processes personal data in relation to the Santoni Society programme can be found in the “Privacy Policy” and “Cookie Policy” sections of the website. Please read the sections carefully and be sure to check back regularly for any changes or updates. - Jurisdiction and Applicable Law
These terms and conditions shall be governed by and construed in accordance with Italian law, to the exclusion of rules on conflict of laws and private international law. The United Nations Convention on Contracts for the International Sale of Goods (Vienna, 1980) shall not apply. In the event of any discrepancy between the Italian language version of these terms and conditions and the terms and conditions in the language in which you accepted them, the meaning and construction of the Italian language version shall prevail.
Any dispute arising from or in connection with the construction and/or enforceability of these terms and conditions shall be referred to the exclusive and binding jurisdiction of the court of the place of domicile or residence of the Customer, if located on Italian territory. If the Customer's domicile or residence is located in a territory other than Italy, the Customer may take legal action, at his/her choice, before the court of his/her place of residence or domicile or the court of Milan, where Santoni has its registered office. Alternatively, in accordance with Article 14 of Regulation (EU) No 524/2013, the Customer may initiate one of the out-of-court dispute settlement procedures provided for by legislation in force (including, for example, the procedure provided for by the online platform made available by the European Commission, which can be accessed via the website http://ec.europa.eu/odr).

ONGOING INITIATIVES
The Santoni International Warranty is an exclusive service reserved to Santoni Society members, which provides the possibility of extending the duration of the product warranty, which by law is two years from the date of purchase, by one additional year.
To activate the International Warranty for the individual product purchased, contact Customer Service. Alternatively, use your smartphone to scan the QR-CODE provided on the Santoni Society Card or tap the NFC tag provided on the product purchased, and then complete the form that appears on your screen, following all the instructions provided. The NFC tag uses Near-Field Communication technology to enable the communication of data over short distances with a device (such as your smartphone), providing the device is within range and the NFC system is activated. The NFC tag provided on Santoni products enables you to receive information on the product you have purchased, such as the features of the model and how it was made and other personalised information, by completing a form and accepting our privacy policy. Please be advised that if you have purchased more than one product, the International Warranty will need to be activated for each single product.
In order to exercise the International Warranty, it is necessary to keep the invoice, or receipt of payment, for proof of purchase of the product and verification of the three-year warranty term. The warranty will be applicable providing that the product has been used correctly, in accordance with its intended use and as stated on the care instructions provided with or attached to the product (in this regard, please remember that Santoni Products require special care and attention in their use and storage to preserve their technical features and appearance over time). Where the warranty requires the product to be returned, it must be returned by the Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessories). To exercise the International Warranty, write to Santoni at the email address society@santonishoesit.com and follow the instructions that will be provided.
Once the product has been returned to Santoni, it will be inspected by our quality department. Should the reported defect or non-conformity be confirmed, we will proceed with the repair or replacement of the product, where possible. If the inspection instead rules out any defect or non-conformity, we shall notify the Customer and return the product received, charging the latter for any shipping costs and/or any other costs, taxes and/or duties that may be applicable.
In the event that, for whatever reason, Santoni is unable to repair or replace the product, or if the repair or replacement is, even based on the value of the product, deemed to be too expensive, the Customer shall be entitled to a proportional reduction of the price paid (taking into account the extent of the conformity defect), or alternatively, may terminate the contract of sale with the return of the full amount paid. The Customer does not have the right to terminate the sales contract if the conformity defect is deemed to be minor.
